This limitation applies regardless of the legal theory of liability, including contract, tort, negligence, strict liability, or any other theory, even if Prime Harbor has been advised of the possibility of such damages.

Exceptions. Either party may pursue the following claims in court rather than arbitration: (a) claims for injunctive relief related to intellectual property; (b) small claims court matters within that court’s jurisdiction; (c) claims that applicable law prohibits from being arbitrated.
Insurance Policy Disputes. Disputes regarding the issuance, terms, coverage, claims handling, or administration of any insurance policy issued by an insurance carrier are governed by the policy contract, applicable state insurance law, and the dispute resolution procedures specified in the policy or by state regulation, not by this arbitration provision.
19. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
20. Entire Agreement
